USER/PURCHASING AGREEMENT

 

PLEASE READ THE FOLLOWING USER AGREEMENT CAREFULLY BEFORE PURCHASING AND OR USING OUR PRODUCTS AND SERVICES.

You agree to and understand the following in its entirety:

This Sheely Supply LLC User/Purchasing Agreement (“User/Purchasing Agreement”), the Sheely Supply LLC Warranty Policy (“Warranty Policy”), and all policies posted on our sheelysupply.com domain, sub-domains, other Sheely Supply LLC Powered sites, the Sheely Supply LLC mobile applications, any available Sheely Supply LLC APIs, and all other related services, websites, applications, and tools furnished to you in Sheely Supply LLC's online shopping marketplace, telephone sales, walkin customer service,  describe the terms and conditions with which Sheely Supply LLC offers You, a registered user, (also referred to as “you”, “your”, “user”, or “Sheely Supply LLC user, customer”) may access and use our heavy equipment, attachments, parts, diesel engines, marketplace services (collectively, “Services”). When You accept the terms and conditions of this User/purchasing Agreement, You hereby agree and acknowledge that at any time and in our sole discretion, we may modify the terms and conditions of this User/Purchasing Agreement. If we make changes to the terms and conditions of this User/Purchasing Agreement, we will notify you of such changes, through email and/or by posting the modified User/Purchasing Agreement on the Sheely Supply LLC website and by updating the “Last Revised Date” at the bottom of this User/Purchasing Agreement. All modified terms and conditions shall take effect immediately after posting to the Sheely Supply website, or upon the stated date included within our notice. Your continued use of the Sheely Supply Services following the effective date of such changes will constitute your acceptance and consent to any and all modified terms. This User/Purchasing Agreement may not be modified, amended, and/or changed by You in any manner. Furthermore, You agree that we may modify this User/Purchasing Agreement or discontinue our Services at any time and without notice and without any liability or responsibility to You.


NON-DEFECTIVE PARTS RETURN AND ORDER CANCELLATION POLICY

We make every effort to provide you with the best service and highest quality product possible. If you are not pleased with your purchase, you may return it for a full credit according to conditions stated below. Adherence to the return procedures and cancellation policies will help assist solving the problem.

Return Policy

All items must be returned within 10 days of delivery receipt.

Gasket sets, gaskets, seals, electric parts, fuel system parts are non returnable and non refundable. 

All items must have a return goods  authorization number assigned before returning.

All items must be in original packaging and original condition. We will not accept items that display signs of wear, installation, or use.

All returned items must have prepaid freight. It is the user's responsibility to pay return freight.

Returns will take up to 10 days for processing upon the date of receipt of the returned products.

Returned items must be in a re-sellable condition if not the item will be returned at the customer's expense.

A 20% restocking fee will reflect on the credit issued upon approval if the return.

Credit Card Charge Backs. You must return products purchased before you receive credit. A credit card charge back issued to us for un returned merchandise will not be tolerated.

Customer is responsible for all risk of loss and damage of products being shipped for return, exchange or replacement. Please fully insure a return shipment in case of loss or damage. Please use a carrier that is able to provide you with proof of delivery such as UPS, FEDEX or DHL. This is for your protection as well as to ensure quick action on your return.

Refusing a shipment. If we receive back a shipment that has been refused, you will be charged shipping in directions (to and from you). No credit will be issued except against an exchange for other merchandise. 

 

Shipping

If a product shipped by us is damaged at the time of delivery, refuse the shipment. If you decide to accept the product and then discover that it has been damaged, call us immediately. Be sure to same all paperwork, packing material, and take pictures of the damage. The carrier may wish to inspect it before processing the claim. Do not return damaged in shipment products yourself. The additional packing will jeopardize your claim and keep you from receiving credit for the return. 

Damages upon receipt;

Inspect your purchased products thoroughly before signing for the shipment. It is the customers responsibility to take pictures


We can ship to virtually any address in the world. Note that there are restrictions on some products, and some products cannot be shipped to international destinations.

When you place an order, we will estimate shipping and delivery dates for you based on the availability of your items and the shipping options you choose. Depending on the shipping provider you choose, shipping date estimates may appear on the shipping quotes page.

Please also note that the shipping rates for many items we sell are weight-based. The weight of any such item can be found on its detail page. To reflect the policies of the shipping companies we use, all weights will be rounded up to the next full pound.

 

Parts Warranty Policy

All new replacement parts are warranteed to be free of defects in material and manufacturing workmanship under normal use and service. Warranty coverage period is decided by each manufacturer. Al warranty coverages are different by manufacturer. Contact us about a products particular warranty period. Upon return of a product with warranty consideration we will take the necessary steps to file the claim with the manufacturer. Upon approval from the manufacturer we will issue a replacement part. We don not control how long the manufacturers process takes to determine eligibility of a warrantable part.

Warranty coverages are listed below;

USED Replacement PARTS/REMANUFACTURED MACHINE PARTS

Buyer agrees that there is no warranty or returns of a used part, remanufactured part or machined part.

Diesel Engine Replacement Parts

Internal engine parts (i.e. pistons, rings, liners, etc) and external engine parts (i.e.oil & water pumps, turbochargers, etc)are warranted to be free from defect in material and workmanship for a period as specified from the OEM manufacturer.

General Equipment Replacement Parts

Warranty consideration for general equipment replacement parts are governed by the Manufacturer. Contact us to determine the correct manufacturer warranty period by the part type. Credit will be issued for approved warranty claims by the manufacturer. No returns or warranty on electrical parts.

Surplus Equipment Replacement Parts

Buyer agrees that there is no warranty expressed or implied on surplus parts shipped from a third party vendor. Returns are not accepted. All sales are final. 

Rebuilt Diesel Engines

Rebuilt diesel engines carry 6 months / 750 hours parts and labor warranty. Labor reimbursement will be provided in a form of credit from Sheely Supply LLC. Credits will be issued for labor in accordance to a labor time guide or Sheely Supply LLC's discretion. Parts warranty credit or replacement parts will be provided by the manufacturer of the part. At time of warranty consideration, the customer must provide, service history, service invoices, oil sample, coolant sample analysis during the warranty period. Receipts of OEM genuine factory filters to include, air inner and outer, fuel primary and secondary, oil filters must be used during the warranty period. Warranty start date commences at time of product delivery. No warranty expressed or implied on engine oil leaks, general recommended maintenance of any rebuild engine. Warranty only applies to new OEM parts used in a rebuilt diesel engine. We are not responsible for charges of machine down time, service charges of removing and replacing the subject warranty engine from the equipment. Buyer is responsible for return freight to and from. 

Used Equipment

Seller has full authority to sell and transfer said equipment and it is sold free of all liens, encumbrances, liabilities and adverse claims of every nature and description whatsoever.

Customer has inspected the equipment either at Sheely Supply LLC's location or other storage area, or has determined to purchase said equipment over the internet with pictures and or additional images. The buyer has accepted the equipment in its existing condition. Buyer agrees to purchase said equipment as sold in "AS IS -WHERE IS CONDITION" as received, with No warranty expressed or implied. The buyer is responsible for any and all taxes associated with this sale. the buyer releases and forever discharges the seller, its affiliates, subsidiaries, directors, officers, employees and their heirs, executors, administrators, legal representatives, and assigns from all manner of actions, causes of action, debts, accounts, bonds, contracts, claims and demands, associated with the purchase and use of the subject equipment. The buyer acknowledges that this release is given with the express intention of effecting the extinguishments of certain potential obligations owed to the buyer, and with the intention of finding his or her spouse, heirs executors, administrators, legal representatives and assigns. 

Used Attachments
